Auctify is intended to be a friendly and useful experience, but as with anything concerning any kind of transaction there are risks involved and we strongly advise you to understand all of these terms before joining. If you see a listing that you feel is violating the general terms and conditions of Auctify as stated below then please let us know and contact us as soon as possible.

Links To Other Web Sites: Our Service may contain links to third-party web sites or services that are not owned or controlled by Auctify. Auctify has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Auctify shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Rights To Suspend or Terminate: You agree that Auctify, at its own discretion, may terminate any listing or use of the service immediately and without notice if
(1) We believe that you are not abiding by the safe trading rules and policies of Auctify. Best-practices: click here.
(2) You have repeatedly broken a certain term
(3) You have listed a suspicious item
(4) We believe you to be a non-paying bidder. In most cases when we suspect foul play we will suspend your account/listing whilst we investigate further. If our investigation is conclusive then your account with us will be terminated.

Limitation Of Liability: In no event shall Auctify, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Your Conduct: You are solely responsible for the contents of your actions through Auctify. You must ensure that your participation in the selling or buying of items does not violate any applicable laws or regulations. By this we mean that you must check that you entitled to sell or buy the relevant item and that you are not prohibited from doing so by any law or regulation. There are certain items that are prohibited to sell at Auctify, the list of those items can be found here: click here. You must not transmit through the service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable law or regulation.

Membership: Membership to Auctify is only available to those you can form a legally binding contract. Auctify does not permit minors (under 18) to register. If any member fails to signup with their correct age the account will be terminated immediately.

Acknowledgment of Pricing Structure: By using our services at Auctify, you acknowledge and agree to our pricing structure as outlined on our website. It is important that you review the pricing details at our pricing page before engaging in any transactions or services offered by us. This pricing structure is an integral part of our terms and conditions, and by continuing to use our services, you are agreeing to these terms. Please note that our pricing is subject to change, and we recommend regularly reviewing the pricing page for any updates. Your agreement to these pricing terms ensures a transparent and fair experience for all our users. General Terms: This site acts as the window for sellers to conduct auctions, as well as facilitating direct selling for buyers interested in purchasing products outright. We are not involved in the actual transaction between buyers and sellers, we have no control over the quality, safety, or legality of the items listed the truth or accuracy of the listings, the ability of sellers to sell items, or the ability of buyers to buy items. We cannot and do not control whether or not sellers will complete the sale of items they offer or buyers will complete the purchases of items they have bid on. In addition, note that there are risks of dealing with foreign nationals, underage persons, or people acting under false pretense. Auctify shall not be liable for any items sold through its platform, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer and/or seller. Auctify shall not be responsible for the cost of procurement of substitute goods or any losses resulting from any goods purchased or obtained. Auctify assumes no liability for the content of the listings. However, if you fall victim to a fraudulent transaction we will assist you as much as we can.

You authorize Auctify to showcase your listings on our other websites, including Auctify.com and Auctionsnearme.com.

Anti-sniping: To prevent people from winning auctions at the last minute (also known as sniping), Auctify automatically extends the auction timer if a bid is placed in the final seconds. This gives other interested bidders a chance to submit higher bids.

Changes: We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Laws: These Terms of Service shall be governed by and constructed in accordance with the laws of the Netherlands. Any disputes and court cases are handled by the court in the Netherlands.
